Among 86 criminal proceedings sent by the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU) and the prosecutors of the Specialized Anti-Corruption Prosecutor's Office (SAPO) to courts, 23 decisions were passed only. 17 convictions came into force. It should also be noted that on September 1, 2017, the conviction as of Alihman Akhmedov came into force. Akhmedov was sentenced as an intermediary in proceeding as of the facts of receiving an improper advantage by the judge of the Severodonetsky City Court of Luhansk Region.Among the most resonant cases, in which pre-trial investigations were completed, should be mentioned the proceedings related to funds embezzlement of the State Enterprises Public Joint Stock Company (PJSC) Ukrgazvydobuvannya, State Enterprise Plant Electrotyazhmash, PJSC State Food and Grain Corporation of Ukraine, PJSC Odessa Port Plant.
At the same time, the trials haven’t started yet regarding one third of the cases in which the Detectives of the National Anti-Corruption Bureau of Ukraine completed the pre-trial investigation and the prosecutors of the Specialized Anti-Corruption Prosecutor's Office sent the indictment to courts.
There are a lot of reasons why the courts fail to start considering the NABU cases: the problem of determining jurisdiction, lack of time and recusals of judges, failures to appear in courts, etc. For example, in the criminal proceeding as of the facts of giving an improper advantage to the military prosecutor of the Southern Region of Ukraine, a preparatory meeting set on August 19 did not take place. The next meeting is set on October 18.
There are also «cases-champions», in which the preparatory meetings haven’t been set for more than a year and a half. The trial as of the case of unlawful influence on the Minister of Economic Development and Trade of Ukraine has not started for more than 16 months.
Next meeting was set on September 26, the previous one did not take place due to non-appearance of the defense.
The preparatory meeting as of the criminal proceeding regarding the judge of Zhovtnevyi District Court of Dnipro (also known as the judge who was detained the first time after the entry into force of the amendments on limitation of judicial immunity), has not been set at all, while the indictment was sent to court in January 2017.
