The investigation as of the facts of demanding and receiving an improper advantage by two officials of Ukrgasvydobuvannia PJSC (100% of the shares belong to the state-owned Naftogaz of Ukraine NJSC) was completed. On January 20, 2020, SAPO Prosecutors sent an indictment to the court.
According to the investigation, in February 2018 Ukrgasvydobuvannia PJSC (it became JSC from May 2018) announced the threshold purchases. After the tender proposals were announced, the Director for gas preparation and transportation and the Head of the Mechanical-Technological Department of Ukrgasvydobuvannia JSC, acting upon prior conspiracy and on selfish motives, set a condition before the head of the enterprise, whom proposal was the most profitable and justified. According to this condition, the head of the LLC had to provide an improper advantage; otherwise, his proposal would be rejected.
As a result, in September-December 2018, the associates received an improper advantage in parts of a total of UAH 26.9 million for actions in the interests of the LLC. The accused divided the received funds among themselves.
The NABU Detectives under the procedural guidance of SAPO Prosecutors has been conducted the pre-trial investigation as of these facts since April 2019.
The actions of the accused persons are qualified under Part 4 of Article 368 of the Criminal Code of Ukraine (“Accepting an offer, promise, or receipts of improper advantage illegal benefits by an official”). If found guilty, the accused persons may face imprisonment from 8 to 12 years with seizure of property and with disqualification to hold certain positions or to be engaged in certain activities for up to three years.
According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
