NABU exposed corrupt scheme of causing UAH 13.7 million damages to Electrotyazhmash Plant

On March 17, 2020, the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU), under the procedural guidance of the Specialized Anti-Corruption Prosecutor`s Office (SAPO) gave notices of suspicion to five persons. They are suspected of causing UAH 13.7 million damages to Electrotyazhmash Plant. The actions of the suspects are qualified under Part 2 Article 364 of the Criminal Code of Ukraine.

Among suspects there are:

  • two Deputy Directors of the Electrotyazhmash Plant;
  • Head of the Department of the Electrotyazhmash Plant;
  • Ultimate beneficiary of the Czech company;
  • Director of the Czech company.

The investigation revealed that officials of the Electrotyazhmash Plant, through fictitious company controlled by them (registered in Prague (Czech Republic), organized the sale of spare parts to the real company (the Republic of Lithuania).

The Electrotyazhmash sold spare parts to the Czech company for EUR 600.3 thousand and it were resold to the Lithuanian company for almost twice the price - EUR 1.22 million. Those actions resulted in 13.7 million UAH damages caused to the Electrotyazhmash Plant, which is confirmed by expert reports.

The NABU Detectives started a pre-trial investigation as of the abovementioned facts in November 2017. This is the third corruption scheme exposed by NABU and SAPO at Electrotyazhmash.

In 2014-2015, the State Enterprise (SE) sold electric motor to fictitious companies at prime cost (USD 1.39 million). Those companies resold it to the Republic of Kazakhstan at a market price of USD 3 million. Because of those actions, UAH 37.22 million damages were caused to the SE. In December, the investigation as of ex-Deputy Director of the Electrotyazhmash Plant on abusing of authority was completed and indictment was sent to court.

In addition, NABU exposed three more officials of the SE on receiving USD 37 thousand of improper advantage for the organization of timely release of products in accordance with the signed contract. At the beginning of 2018, the investigation as of that fact was completed and indictment was sent to court.

 

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
