Report on the results during the second half of 2018: the NABU proved to be an effective law-enforcement body

Among 176 cases, in which the NABU Detectives completed the pre-trial investigations, the National Anti-Corruption Bureau of Ukraine (NABU) as a law-enforcement body fulfilled its task. Further, the task of the Specialized Anti-Corruption Prosecutor's Office of Ukraine (CAPO) is to prosecute persons, and the task of the court is to found guilty or non-guilty corrupt officials. This was emphasized by the NABU Director Artem Sytnyk on February 8, 2019.

“In the second half of 2018, 44 persons were given notices of suspicion, and cases as of 61 persons were completed. However, as before, there are a negative tendency when cases are not considered by court. Out of 28 NABU’s proceedings sent to court during last 6 months, the hearings on merit have started only in 8 cases. Other cases are at the stage of the preparatory meeting,” said Artem Sytnyk at the presentation of the Report on the NABU results during July-December, 2018.

The NABU Director noticed that court sentences are the only way to punish corrupt officials and to return the embezzled funds to the State.

“At least 9 billion UAH may be returned to the State after the sentencing in cases of the NABU and the SAPO. However, unfortunately, because cases in the courts are not considered, these funds are still inactive assets. I hope the High Anti-Corruption Court will start its work as soon as possible to change the situation”.

At the same time, while courts are delaying the decision-making process, the NABU urges the suspects to return the funds during the pre-trail investigation.

“In 2018, 200 million UAH was returned to the State,” the NABU Director said.

According to Artem Sytnyk, due to the NABU`s lawsuits, the court declared invalid 94 agreements for a total amount over 4.77 billion UAH. This means that State Enterprises have real grounds for returning stolen resources.

At the same time, cases related to corruption at State Enterprises are the most prevalent among all investigations.

“We investigate corruption facts revealed at more than 30 State Enterprises. According to preliminary estimates, the total amount of losses they suffered exceeds 18 billion UAH,” the NABU Director noted.

Artem Sytnyk said, that the establishment of the Higher Anti-Corruption Court (HACC) became the main achievement of Ukraine in the fight against corruption during the second half of 2018.

“We have a definite shift in this direction. There are people who, in our opinion, have sufficient professional and moral qualities to work at the HACC. I ask these people do not afraid to confront top-level corruption, as we do at the NABU. Only the joint work of the three institutions – the NABU, the SAPO and the HACC – is the key to Ukraine's success in combating corruption,” emphasized the NABU Director.
