Under the law, any public official, who has declared his or her income from “teaching” activity, cannot be charged for misdemeanor, stressed the Director of the National Anti-Corruption Bureau of Ukraine Artem Sytnyk during the briefing.
Commenting the Security Service of Ukraine (SBU) drawing up an administrative protocol on one of the NABU employees, he said: "According to thelaw, teaching and creative activity are allowed for civil servants. When a person has abilities and talent, I see nothing wrong if they teach others. Prosecutors also do so!"
The NABU Director was outraged by the fact that officers of the central apparatus of the Security Service of Ukraine (the "K" Department) exposed "such a serious breach of the Law and as a result on Friday night the four of them came to the NABU employee home to hand a protocol on administrative offense."
"The final decision in this matter will be made by the court. But I think that "K" Department should work on more serious tasks than just bringing civil servants to administrative responsibility," said Artem Sytnyk.
It should be reminded that according to official notice of the Security Service of Ukraine, SBU officers drew up an administrative protocol against the Deputy Chief of one of the departments of the National Anti-Corruption Bureau of Ukraine.
For reference: according to Paragraph.1, Part 1 of the Article 25 of the Law of Ukraine “On Preventing Corruption”, persons referred to in the Paragraph 1 of the Part 1 of the Article 3 of this Law are prohibited to be engaged in any paid (other than teaching, research and creative activity, medical practice, instructor and judicial practice in sports) or entrepreneurial activities, unless otherwise is stipulated by the Constitution of Ukraine or other laws of Ukraine.
According to the decision of the Constitutional Court of Ukraine in the case, initiated by a constitutional petition of the Supreme Court of Ukraine, on the constitutionality of the Laws of Ukraine "On Principles of Prevention and Combating Corruption", "On the Liability of Legal Persons for Corruption Offenses", "On Amending Certain Legislative Acts of Ukraine Regarding Liability for Corruption Offenses" (a case on corruption offenses and enforcement of anti-corruption laws) №21-rp/2010 dated 06.10.2010 training is a type of a teaching activity because it is aimed at receiving, distribution and use of new knowledge, professional skills and their practical application.
