“Ukrtelefilm” case: investigation completed

The Detectives of the National Anti-Corruption Bureau of Ukraine (NABU) completed the investigation as of the facts of causing more than 68.72 million UAH damage to the State Enterprise “Ukrainian Television Film Studio “Ukrtelefilm”. On April 26, 2019, three suspects — ex-Director, his accomplice-organizer of the scheme, Head of the Limited Liability Company (LLC) involved in the scheme — and their lawyers were granted with access to the materials of criminal proceeding for review.

The investigation revealed that ex-Director of “Ukrtelefilm” in conspiracy with some persons alienated property rights for 67 real estate objects located in Kyiv (apartments, non-residential premises, parking spaces). These actions were committed with numerous violations of the procedure for the alienation of state property, in particular, without agreeing with the governing body — the State Committee for Television and Radiobroadcasting. As a result, 68.72 million UAH damage was caused to the State.

On February 6, 2019, ex-Director General of the SE “Ukrtelefilm” was given a notice of suspicion of abuse of office and the use of fake documents (Part 2 Article 364, Part 4 Article 358 of the Criminal Code of Ukraine). The notices of suspicion also were given to his accomplices: organizer of the scheme (committing a crime under Part 3 Article 27, Part 2 Article 364, Parts 1, 4 Article 358, Part 3 Article 209 of the Criminal Code of Ukraine) and Head of the LLC (Part 5 Article 27, Part 2 Article 364, Part 4 Article 358, Part 3 Article 209 of the Criminal Code of Ukraine).

The NABU Detectives started the investigation of this criminal proceeding in February 2018.

In November 2018, the Commercial Court of Kyiv declared invalid the agreement of sale of specified property rights with all additional agreements, amendments and additions to it.

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
