
On February 25, 2019, the Deputy of the Kyiv City Council (who is also known as the ex-secretary of the Land Commission) was given a notice of suspicion of misappropriation of six land plots and 19.5 million UAH illegal enrichment. Actions of the official are qualified under Part 5 Article 191, Part 3 and Part 4 Article 358, and Part 1 Article 368-2 of the Criminal Code of Ukraine. Also, his accomplice was given a notice of suspicion of committing a crime under Part 5 Article 27, Part 5 Article 191 of the Criminal Code of Ukraine.
The investigation revealed that the Deputy of the Kyiv City Council, holding the post of Secretary of the Kyiv City Council of Land Resources (hereinafter - the Commission), and having access to data on the availability of lands in Kyiv, during 2008-2014 organized a scheme of misappropriation of six land plots. The total value of these lands exceeds 2.5 million UAH.
According to the NABU Detectives, the abovementioned official has involved his relative in the realization of a corruption scheme. On the orders of the Deputy, the relative searched persons who could privatize lands in the Holosiivsky District of Kyiv, which were in communal ownership.
After the list of persons was prepared, the official initiated the issue of allocation of lands to the agenda of the Commission. Then, at the session of the City Council, the suspected Deputy jointly with other deputies, voted for the appropriate decision.
As a result of such action, six land plots with a total area of 0.47 hectares were allocated to predetermined persons who actually did not know about it. Then, the NABU Detectives found that the allocation of lands to private property was based on the fake documents.
The abovementioned facts are the second NABU`s investigation as of the facts of the misappropriation of land plots in Kyiv with alleged involvement of the ex-secretary of the Commission. Earlier, in September 2017, the official was exposed on misappropriations of 3 land plots with a total area of 0.26 hectares in Kyiv. Eight months later, the NABU Detectives completed the pre-trial investigation, and the SAPO prosecutors sent the indictment to court. Currently, the case is under trial in the Shevchenkivsky District Court of Kyiv.
In addition, the NABU Detectives found that in 2015-2016, the Deputy acquired assets totaling 19.5 million UAH, the legality of grounds for obtaining of which is not confirmed. Part of this amount was spent on the purchase of luxury SUV, the rest was invested in corporate rights and real estate, which bring profits to the Deputy of the Kyiv City Council.
The investigation as of the abovementioned facts was started in September 2016 by the NABU Detectives.
According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
