Ukrspecexport UAH 13 mln losses: ex-company director, son of former NSDC official served with charges
On Oct. 6, 2023, NABU and SAPO notified the former director of Ukrspecexport SE and the son of the former First Deputy Secretary of the National Security and Defense Council of Ukraine of suspicion of organizing and abusing official position, resulting in losses to the state worth UAH 13 million.
Their actions fall under Part 2 Art. 364 of the Criminal Code of Ukraine.
The investigation revealed that the former Ukrspecexport director, abusing his official position, signed a contract with a company controlled by the son of the former First Deputy Secretary of the NSDC to purchase onboard radio electronic equipment (altimeters) at intentionally inflated (almost 7 times) prices (approximately USD 450,000).
Upon receiving the specified payment from the state-owned company, the participants in the scheme took complete control of the funds. Part of them in the amount approximately USD 170,000 was transferred directly to the son of the former official. While committing the crime, the former director of Ukrspecexport took measures to conceal his involvement in the scheme and recommended involving companies from specific foreign jurisdictions that he deemed safe and unlikely to expose the crime to Ukrainian law enforcement authorities.
After receiving responses to requests for international legal assistance from the competent authorities of the United Arab Emirates and the Hong Kong SAR of the People's Republic of China, NABU detectives got evidence of the actual value of the delivered equipment, as well as the role and involvement of the relevant foreign companies and their officials.
As the suspects are currently residing outside Ukraine, they were notified of suspicion in absentia. Detectives started probing the above facts based on the materials of a journalistic investigation.
As reported, the son of the former Deputy Secretary of the NSDC is also a participant in another criminal case related to receiving UAH 950,000 in undue advantage for influencing the Ukrspecexport director. The case is being heard in court.
According to Article 62 of the Constitution of Ukraine, a person is considered not-guilty in the commission of a crime and cannot be subject to criminal punishment until he or she is found guilty by court.
