NABU prevented MP Boryslav Rosenblat taking abroad materials important for the investigation of the "amber case"

On October 19, 2017, the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU) prevented an attempt of Member of Parliament (MP) Boryslav Rosenblat to take abroad materials of the pre-trial investigation of the so-called "amber case". The NABU Detectives also ensured his participation in the court hearing as of prolonging his preventive measure.

Investigative actions (a search in an airplane) were conducted according to Part 3 Article 233 of the Criminal Procedural Code of Ukraine (before the investigating judge’s ruling) with the purpose of saving property that may serve as evidence.  At the same time, the MP himself was not detained.

The investigation revealed that the suspect planned to take out of the territory of Ukraine means of communication that could contain information on his concealment of traces of previously committed crimes and on communication between its participant. He was also trying to export funds (previously obtained improper advantage) and  other property. In addition, the Detectives had information that the suspect could have had documents for traveling abroad with signs of forgery.

During the search, conducted directly on the plane, the NABU Detectives seized mobile phones, a tablet, jewelry, a passport of a citizen of Ukraine for traveling abroad and a diplomatic passport.

We emphasized that the MP used a diplomatic passport for crossing the border, although his trip was private and was not related to professional duties.

According to data received by the NABU Detectives from the Verkhovna Rada of Ukraine and the Ministry of Foreign Affairs of Ukraine, the diplomatic passport was received by Boryslav Rosenblat on October 17, 2017, in response to his request for a working visit to Israel on 18-22 October. There he was planning to explore cooperation possibilities between Ukraine and the Federation of Israeli Chambers of Commerce and the Manufacturers Association of Israel.

But according to the seized airline tickets, at that time the MP was planning to stay in Germany.

Also Mr. Rosenblat was handed a subpoena. He was required to appear in the Solomyansky District Court of Kyiv for extension of his suspect’s duties.

It should be reminded that the MP Boryslav Rosenblat is suspected of receiving an improper advantage and trading in influence. The court chose a preventive measure in the form of 7 million UAH bail. Also, according to court decision he must wear an electronic monitoring device and must pass foreign passports. The term of these duties expired on October 16, 2017. The court could not continue trial because of the absence of a suspect to consider the relevant petition.

The subpoena handed to Boryslav Rosenblat on October 19, 2017, was already the third in last six days.

It should be reminded that on June 19, 2017, the NABU Detectives under the procedural guidance of the Anti-corruption prosecutors detained 7 persons involved in demanding and receiving improper advantage for the assistance to a foreign company in the realization of amber mining in Ukraine.

On July 11, 2017, the Verkhovna Rada of Ukraine gave a permission to bring to criminal liability MPs Boryslav Rosenblat and Maksym Poliakov involved in the "amber case". However, the submission filed by the the Prosecutor General of Ukraine for the detention and arrest of MPs was not supported by the Verkhovna Rada of Ukraine.
