Ex-Commander of the National Guard detained on suspicion of 81 million UAH misappropriation

On May 14, 2019, the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU), under the procedural guidance of Prosecutors of the Specialized Anti-Corruption Prosecutor's Office (SAPO), detained former Commander of the National Guard of Ukraine on suspicion of misappropriation of the property of the Main Department of the National Guard in the amount of 81.64 mln UAH. Executive director of real estate developer and real estate appraiser were also detained.

 

The actions of ex-Commander of the National Guard and executive director of the real estate developer are qualified under Part 5 of Article 191 of the Criminal Code of Ukraine. Actions of the appraiser are qualified under Part 5 of Article 27, Part 5 of Article 191 of the Criminal Code of Ukraine.

On May 14, 2019, they were given notices of suspicion.

On May 16-17, 2019, the judge of the Solomyansky District Court of Kyiv chose preventive measures in a form of temporary custody with 4.8 million UAH alternative bail for ex-Commander of the National Guard, in a form of temporary custody with 2 million UAH alternative bail for executive director of the real estate developer, and in a form of temporary custody with 1.5 million UAH alternative bail for the appraiser.

Investigation found out that in the 2000s, the National Guard and real estate developer signed an agreement according to which a residential complex with built-in parking and non-residential premises would be constructed on the territory of the former military unit. In exchange for a land plot of about 1 hectare in Kyiv city center, the National Guard was offered 50 apartments and 30 parking lots in the residential complex.

However later, in 2016-2017, the parties signed additional agreements, according to which the National Guard gave up apartments and parking lots in Pecherskyi district in exchange for 65 apartments in a residential complex of the same real estate developer in Kyiv outskirts (near Chervonyj Khutir metro station). Expertize carried out within the framework of the pre-trial investigation established that the cost of these apartments is 81 635 448 UAH less than the first one to be received by the National Guard according to initial agreement.

The NABU Detectives carry out the investigation of these facts starting from December 2017 based on the materials of BIHUS.INFO journalist investigation program.

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
