Case as of causing UAH 25.4 mln damages to the United Mining and Chemical Company sent to court

On August 4, 2020, the indictment as of the ex-Deputy General Director of the private company and Director of Eco-Service Trading House LLC was sent to court. Abovementioned persons are accused of committing a crime under Part 5 Article 191 of the Criminal Code of Ukraine.

The investigation revealed that from February to May 2015, the ex-Head of the Eastern Mining and Processing Plant SE (EMPP) concluded additional agreements with the Director of Eco-Service Trading House LLC to the agreement for the purchase of minerals (sulfur) for the needs of the SE. Thus, they illegally increased prices up to 31%, and then – to 57%.

The cost of purchasing sulfur increased gradually, as at least three intermediary companies were involved in the sale process. As a result of their actions, the SE suffered more than UAH 24.5 million damages. Due to the NABU investigations, agreements, concluded by the officials during the purchases, were annulled by the court decision. to return UAH 25.4 million from the private company to EMPP.

Within the investigation, based on the request of NABU and SAPO, the corporate rights of the company worth more than UAH 11 million belonging to one of the suspects were seized. Seized property were transferred to the National Agency of Ukraine for finding, tracing and management of assets derived from corruption and other crimes.

The NABU Detectives started the pre-trial investigation in March 2018. 

In autumn 2019, the ex-Director of the EMPP and the Director of Eco-Service Trading House LLC were given a notice of suspicion.

The pre-trial investigation as of both persons was carried out in accordance with Article 297-1 of the Criminal Procedure Code of Ukraine (special pre-trial investigation). They were put on the wanted list. The NABU Detectives jointly with the Ukrainian bureau of Interpol and law enforcement agencies of other countries establish the location of the accused for their detention.

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
