Indictment as of two judges from Dnipro was sent to court

The Detectives of the National Anti-Corruption Bureau of Ukraine (NABU) under the procedural guidance of the Specialized Anti-Corruption Prosecutor’s Office (SAPO) completed a pre-trial investigation of the criminal proceeding as of the facts of receiving 16 thousand USD improper advantage by two judges of one of the District Courts of Dnipro. On January 11, 2018, the indictment as of abovementioned judges and two more persons was sent to court.

One of the judges (who was the Deputy Head of the District Court) is accused of committing crimes under Part 4 Article 368, Part 3 Article 369-2, Part 1 Article 354, Part 3, 4 Article 358 of the Criminal Code of Ukraine. The second judge is suspected of committing crimes under Part 4 Article 368, Part 3 Article 369-2 of the Criminal Code of Ukraine.

The investigation revealed that the Deputy Head of the District Court of Dnipro by prior agreement with another judge of the same court demanded improper advantage in the amount of 30 000 USD for failing to pass the sentence in a form of imprisonment. The cash was passed on in several tranches. The NABU and the officers of the Security Service of Ukraine detained the abovementioned judges immediately after receiving one of the tranches. On April 20, 2017, the judges were given notices of suspicion for committing a crime.

According to the NABU Detectives, one of the judges used various manipulations to avoid her participation in automated pision of litigation that she did not want to consider. Some doctors (now being considered as partners in crime) provided her fake records of disability. Due to this, the abovementioned doctors are also being prosecuted now: the corresponding indictment has been already sent to court.

The NABU Detectives started investigation of the abovementioned facts in April 2017. On November 17, 2017, the suspects and the defense were granted access to the documents of the pre-trial investigation.

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
