NABU's statement: Procurement procedures during martial law require critical changes
Irregularity of price determination, lack of responsibility, and the possibility of procurement beyond bidding are corruption risks that urgently need to be addressed by the Government. We are talking about Cabinet Resolution No. 1178 regarding the peculiarities of procurement during martial law, which contains such risks.
NABU has prepared proposals aimed at eliminating:
- unjustified price inflation due to the lack of a regulated mechanism for determining the contracting authority's expected cost;
- the possibility to purchase goods/services beyond open auctions;
- lack of responsibility of the contracting authority that fails to verify information about the contractor;
- lack of responsibility of the contractor that provides false information;
- the possibility of an unlimited extension of urgent procurement contracts;
- the fact that advance payment does not guarantee the performance of the contract by the contractor.
The proposals have been sent to the Cabinet and must be considered within a 30-day period.
