Three suspected of massive losses at Centrenergo PJSC
On May 4, 2023, NABU and SAPO notified three persons of suspicion of causing more than UAH 176 million in losses to the state energy enterprise.
The suspects are:
- an ex-Centrenergo Board member - Part 2 Article 28, Part 2 Article 364, Part 2 Article 28, Part 1 Article 366 of the Criminal Code of Ukraine;
- the ex-head of a Centrenergo department - Part 5 Article 27, Part 2 Article 28, Part 2 Article 364, Part 5 Article 27, Part 2 Article 28, Part 1 Article 366 of the Criminal Code of Ukraine;
- the company CEO - Part 5 Article 27, Part 2 Article 28, Part 2 Article 364, Part 2 Article 28, Part 1 Article 366 of the Criminal Code of Ukraine.
Since the whereabouts of the PJSC former officials are unknown, they were notified of suspicion in absentia.
According to the investigation, in 2020, Centrenergo concluded an agreement for the sale of electricity to the auction winner, United Energy LLC. As the company failed to use the contracted electricity volumes, it was to pay a fine. To avoid this, the PJSC retrospectively concluded additional agreements, which excluded the provisions on permissible deviations from the contracted electricity volumes from the main agreement.
These changes allowed the LLC to take any amount of electricity, regardless of the fact that the use of the entire amount of contracted volumes was stipulated by the terms of the auctions.
As a result of these actions, the PJSC failed to receive UAH 176.8 million.
According to Article 62 of the Constitution of Ukraine, a person is considered not-guilty in the commission of a crime and cannot be subject to criminal punishment until he or she is found guilty by court.
