On Oct. 24-25, 2023, NABU and SAPO served charges on an incumbent MP and three other persons who attempted to take over a 320-hectare land plot.
The suspects are:
- an MP;
- the former head of the Main Department of the State Geocadastre in one of the regions;
- the former director of a state-owned enterprise;
- the director of a private enterprise.
Their actions fall under Part 5 Art. 191 of the Criminal Code of Ukraine.
As established, in 2016-2019, the MP having influence over officials of the Main Department of the State Geocadastre in one of the regions, developed a scheme to misappropriate land plots with a total area of 323 hectares, which were in permanent use of a state-owned enterprise. According to the criminal plan, the director of the SOE was supposed to relinquish the land use right and submit an appropriate request to the regional State Geocadastre. After the termination of the land use right, the head of the Main Department of the State Geocadastre of the region registered the land plots with pre-determined persons, who later sold them to companies controlled by the scheme's organizer. Their actions caused over UAH 123 million in losses to the state.
The pre-trial investigation is ongoing.
According to Article 62 of the Constitution of Ukraine, a person is considered not-guilty in the commission of a crime and cannot be subject to criminal punishment until he or she is found guilty by court.
