NABU and SAPO brought to justice 35 persons in March 2020
The NABU Detectives have started pre-trial investigations as of 73 cases in March 2020. 25 persons are suspected of committing corruption crimes within criminal proceedings investigated by NABU and SAPO. Indictments as of 10 persons were sent to court. In one NABU case, the conviction against one person came into force. These are the results of NABU activities as of March 2020.
In March 2020, the NABU Detectives exposed a number of officials on corruption. Among detainees there are:
- eight persons, probably involved in the scheme of causing UAH 51 million damages to three coal mining State Enterprises (SEs): “Selypvugillya” SE, “Myrnohradvugillya” SE and “Shahtoupravlinnya Pivdennodonbaske 1” SE (Part 4 Article 28, Part 5 Article 191, Part 1 Article 255 of the Criminal Code of Ukraine);
- four persons, suspected of causing UAH 93.3 million damages to Odesa Port Plant (Part 2 Article 28, Part 2 Article 364 of the Criminal Code of Ukraine);
- five persons, suspected of causing UAH 13.7 million damages to Electrotyazhmash Plant (Part 2 Article 364 of the Criminal Code of Ukraine);
In particular, in March notices of suspicion were given to following persons:
- Head of Western Interregional Department of the Criminal Sentence Enforcement and Probation of the Ministry of Justice of Ukraine, who was exposed on receiving an improper advantage (Part 3 Article 368 of the Criminal Code of Ukraine);
- two witnesses in case as of embezzlement of 92 million UAH from Odesa City budget during purchasing of the buildings of the Open Joint Stock Company (OJSC) “Holding Company “Krayan” (Part 1 Article 385 of the Criminal Code of Ukraine);
- two Members of Parliament (VIII convocation) suspected of illegally receiving compensation for rent (Part 2 Article 364 of the Criminal Code of Ukraine);
- Acting Head of one of the District Courts of Lviv Oblast, who was exposed after receiving an improper advantage (Part 3 Article 368 of the Criminal Code of Ukraine);
In addition, the NABU Detectives completed investigations as of number of criminal proceedings. Among them there are following:
- investigation as of the embezzlement of UAH 20 million as result of corruption scheme at the SE "Management of Industrial Enterprises of the State Administration of Railway Transport of Ukraine" (now – a branch of the Industrial Management Center of PJSC "Ukrzaliznytsia" (Ukrainian railways). The mentioned SE purchased sleepers and bars at prices 80% higher than the average market prices.
- investigation as of receiving an improper advantage by Deputy Head of the State Water Resources Agency of Ukraine;
- investigation as of illegally receiving compensation for rent from the state budget of over UAH 367 thousand and submitting false data to e-declarations by Member of Parliament (VIII convocation).
Among cases sent to court in March there are:
- misappropriation of more than 9.8 hectares of especially valuable land of the Tairov Institute of Viticulture and Enology of the National Academy of Agrarian Sciences of Ukraine - 7 accused (Part 2 of Article 28, Part 2 of Article 364 of the Criminal Code of Ukraine);
- receiving UAH 300 thousand and USD 90 thousand of improper advantage by the Head of the Road Service of Mykolaiv Oblast (Part 4 Article 368 of the Criminal Code of Ukraine);
- submitting false data to e-declarations by the ex-judge of Vyshgorod District Court of Kyiv Oblast (Article 366-1 of the Criminal Code of Ukraine);
- refusal of a witness to testify in case of submitting false data to e-declarations by Member of Parliament (VIII convocation) (Part 1 Article 385 of the Criminal Code of Ukraine).
According to the Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
