NABU continues pre-trial investigation of the so-called Party of Region “black ledger” case

As the result of the work of the joint investigative group of the National Anti-Corruption Bureau of Ukraine (NABU) and the Department of Special Investigations of the General Prosecutor's Office of Ukraine (GPO), a former Member of Parliament (MP) from the Party of Regions and an assistant of another MP from the Party of Regions were given notices of suspicion.

In June 2017 the NABU passed the materials of the pre-trial investigation of the so-called Party of Region “black ledger” case to the GPO. In terms of the pre-trial investigation of the abovementioned criminal proceeding the Chairman of the Central Election Commission of Ukraine (CEC) was given a notice of suspicion. However, due to the fact that the NABU Detectives had evidence regarding other persons, the National Bureau decided to continue the cooperation with the Department of Special Investigations of the GPO.

The former MP and an assistant of another MP were given notices of suspicion for allegedly committing crimes under Part 1 Article 255, Part 4 Article 28, Part 1 Article 369 (according to the Criminal Code of Ukraine (CCU) as of 05.04.2001), Part 5 Article 369 (according to the CCU as of 07.04.2011), Part 3 Article 368-2 (according to the CCU as of 07.04.2011).

In particular, the abovementioned persons are suspected of committing crimes as of the facts of giving an improper advantage to the CEC Chairman. The notices of suspicion are based on the materials of the pre-trial investigation passed from the NABU to the GPO earlier (for example, the conclusions of the graphology examination of the authenticity of more than 150 sheets of “black ledger”). It also contains the evidence and facts of newly discovered circumstances obtained in the process of cooperation of the NABU and the Department of Special Investigations of the GPO.

We emphasized that the abovementioned procedural decision is important for 2 proceedings: as of the facts of the usurpation of power by Viktor Yanukovych and as of the facts of receiving improper advantage by top-officials, in particular, by the Chairman of the Central Election Commission.

It should be reminded that on May 30, 2016, the NABU started the pre-trial investigation of the criminal proceeding based on the documents that were passed to the NABU by Viktor Trepak. On December 13, 2016, the CEC Chairman was given a notice of suspicion in committing crimes under Part 3 and 4 Article 368 of the Criminal Code of Ukraine. The investigation revealed that the CEC Chairman received funds mentioned in the so-called Party of Region “black ledger”. Currently the SAPO terminated the investigation as of the Chairman of the Central Election Commission.

In June, 2017, the SAPO directed the materials of the Party of Regions “black ledger” to the Department of Special Investigations of the Prosecutor General's Office of Ukraine that over the past three years has been investigating the facts of the usurpation of power by Viktor Yanukovych.

We emphasize that the NABU continues the pre-trial investigation of the so-called Party of Regions “black ledger” case as a part of a joint investigative group with the Department of Special Investigations of the GPO.
