Funds embezzlement of "SpetsTechnoExport": the NABU suspected 5 persons

 

On March 4, 2019, the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU) under the procedural guidance of the Prosecutors of the Specialized Anti-Corruption Prosecutor's Office (SAPO) detained the current and former Directors of the State Enterprise "SpetsTechnoExport" and three more ex-officials on suspicion of embezzlement of 2.225 million USD (55.5 million UAH). On the same day they were given notices of suspicion.

 

Among the suspects there are:

- the current Director of "SpetsTechnoExport" (at the time of committing a crime he was the Deputy Director of "SpetsTechnoExport");

- former Director of "SpetsTechnoExport";

- ex-deputy Director of "SpetsTechnoExport";

- former deputy Director of Department of Contract No. 1 "SpetsTechnoExport" (currently – the Head of the LLC);

- the former Head of one of the Departments "SpetsTechnoExport" (currently – the Head of the LLC).

The actions of all suspects qualified under Parts 2, 3 Article 27, Part 2 Article 28, Part 5 Article 191, Part 1 Article 366 of the Criminal Code of Ukraine.

The investigation revealed that in 2009, on the initiative of the "SpetsTechnoExport" executives, State Enterprise signed an agreement with a foreign company to support one of the external economic contracts. Under this contract, "SpetsTechnoExport” had to supply military products manufactured by the State Enterprise "Plant 410 Civil Aviation". A non-resident-intermediary should ensure the conclusion and further implementation of the external economic contract, for which the State Enterprise "SpetsTechnoExport" paid 2.225 million USD. The NABU Detectives found that the intermediary company did not provide the declared services.

The NABU Detectives have been conducting the pre-trial investigation of these facts since December 2017.

"SpetsTechnoExport" is a state-owned, self-supporting foreign trade enterprise, which specializes in export and import activities in a world market of military, dual-use products and services.

"SpetsTechnoExport" falls within the scope of management of the State Enterprise "Ukrspetsexport" (an authorized by the state intermediary in the implementation of foreign economic activities in the sphere of export and import of products and services for military and special purposes).

"Ukrspetsexport" falls within the scope of management of the State Concern "Ukroboronprom".

According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
