“Okhmatdyt Hospital” case: three persons were given notices of suspicion
On May 5, 2020, the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU) under the procedural guidance of the Specialized Anti-Corruption Prosecutor`s Office (SAPO) gave notices of suspicion to three persons involved in causing UAH 30 million damages to the State. Those funds were allocated for the construction of a new building for the medical and diagnostic complex of the National Children's Specialized Hospital “Okhmatdyt”.
The notices of suspicion were given to the ex-Director of the State Enterprise (SE) “Ukrmedproektbud”, the Head of the private enterprise-general contractor and the Head of the company-keeper of equipment that should be used to equip the hospital.
The actions of the ex-Director of the SE “Ukrmedproektbud” are qualified under Part 2 Article 28, Part 2 Article 364, Part 2 of Article 28, Part 1 Article 366 of the Criminal Code of Ukraine.
The Heads of private companies are suspected of committing crimes under Part 5 Article 27, Part 2 Article 28, Part 2 Article 364, Part 2 Article 28, Part 1 Article 366 of the Criminal Code of Ukraine.
The location of the Head of the company-keeper of equipment is being established. He was given a notice of suspicion in accordance with Article 135, Article 278 of the Criminal Procedure Code of Ukraine. The issue of putting him on the wanted list is being decided.
The investigation revealed that in 2013 the suspects upon prior conspiracy fabricated documents that allegedly confirmed the supply of engineering and technical equipment for the new building of “Okhmatdyt”.
In fact, the equipment was not supplied or stored. However, the private enterprise-general contractor received funds for the supplied equipment. As a result, the State suffered UAH 30 million of losses.
The NABU Detectives started the investigation as of the abovementioned facts in September 2016 after transferring materials from the National Police of Ukraine. The Prosecutor General’s Office of Ukraine made the decision on investigative jurisdiction in August 2017.
The investigation is carried out under the operational support of the Main Department of the State Security Service of Ukraine in Kyiv and Kyiv Oblast.
According to Part 1 Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of a crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
