Odesa judge exposed on bribe
On March 29, 2019, the Detectives of the National Anti-Corruption Bureau of Ukraine (NABU), under the procedural guidance of the Specialized Anti-Corruption Prosecutor`s Office (SAPO), jointly with the officers of the Security Service of Ukraine (SSU), exposed on receiving an improper advantage the judge of the Malinovsky District Court of Odesa.He is one more exposed judge from the abovementioned court, whose illegal actions were investigated by the NABU Detectives.
The actions of a judge are preliminarily qualified under Part 3 Article 368 ("Accepting an offer, promise or receiving an improper advantage by an official who occupies a responsible position") of the Criminal Code of Ukraine.
The investigation revealed that the judge received 2,500 USD of improper advantage for decision-making in favour of a citizen in a civil case on resolving a housing dispute.
The NABU Detectives started a pre-trial investigation as of these facts in March 2019.
It should be reminded that three years ago, the NABU Detectives jointly with the National Police officers exposed the judge of the Malinovsky District Court of Odesa on receiving 500 thousand UAH of improper advantage. The case became known as the “case as of judge-shooter”, because during the search, the judge resisted with a gun. Now the case is under consideration of the Zavodsky District Court of Mykolaiv.
According to Article 62 of the Constitution of Ukraine a person is considered not-guilty in commission of crime and cannot be a subject to criminal punishment, until he or she is found guilty by the court.
