Third attempt to bribe State Property Fund Head: case materials sent to court
NABU has completed the probe into an attempt by a former Mykolaivoblenerho JSC (70% state-owned) official to give an improper advantage to the head of the State Property Fund of Ukraine. On June 3, 2021, SAPO Prosecutors filed an indictment drawn up by NABU Detectives to court. The actions of the accused fall under Part 4 Article 369 (offering, promising or giving an illegal benefit to an official) of the Criminal Code of Ukraine.
The investigation has established that the accused offered the SPFU Head USD 100 thousand to get appointed to the position of the Board Chairman at Mykolaivoblenerho JSC (managed by the SPFU). He planned to transfer the money in two parts: USD 50 thousand before and the rest - after the appointment.
NABU and SAPO exposed the official on December 8, 2020 giving the first part of unlawful benefit in the amount of USD 50 thousand. A pre-trial investigation into these facts was launched in September 2020 at the request of the SPFU Chairman.
This is the third case into an attempted bribery of the SPFU Head sent by NABU and SAPO to court. In June 2020, an indictment against two persons who intended to offer the SPFU Head USD 5 million to get a predetermined person appointed to the position of director of PJSC "Odesa Port Plant" (99.5% state-owned) was referred to court. In February 2021, an indictment against a person exposed giving the SPFU Head USD 800 thousand was sent to the court.
According to Article 62 of the Constitution of Ukraine, a person is considered not-guilty in the commission of a crime and cannot be subject to criminal punishment until he or she is found guilty by court.
