Criminal liability for submitting false data to e-declarations must be restored by the end of 2020 — NABU statement
The National Bureau emphasizes on the need to restore the criminal liability for submitting false data to e-declarations by officials authorized to perform state or local government functions as soon as possible.
The legislative amendments must be adopted and come into force by the end of this year. Otherwise, declarants, persons whose activities are financed by taxpayers, may avoid liability for false data submitted by them in the e-declaration for 2020.
In view of this, the National Bureau calls on the Verkhovna Rada of Ukraine to adopt renewing certain provisions of the Law of Ukraine "On Prevention of Corruption" and the Criminal Code of Ukraine as soon as possible. NABU is ready to join the discussion on the relevant draft law and provide the recommendations.

As of October 27, 2020 (the day when the Constitutional Court of Ukraine abolished the responsibility for non-declaration), the NABU Detectives investigated 180 facts of submitting false data to e-declarations by officials within more than 110 criminal proceedings. 7 persons, including 3 Members of Parliament, were given notices of suspicion. 34 cases were sent to court. There are court decisions against 13 persons (6 sentences; cases against 7 persons were closed on non-rehabilitating grounds).
