NABU and SAPO have charged a former first deputy chief of Ukraine’s State Fiscal Service (SFS) with abuse of office and causing multimillion losses to the state.
According to the investigation, a business entity filed a complaint with the SFS challenging a tax collection decision. The suspect, who had the exclusive authority to sign decisions based on reviewing such complaints and acted in the entity's interests, deliberately failed to sign a prepared decision within the prescribed time frame. As a result, the complaint was automatically granted, and the state lost its right to collect over UAH 641 million in taxes and penalties.
The suspect's actions fall under Part 2 of Article 364 of the Criminal Code of Ukraine.
According to Article 62 of the Constitution of Ukraine, a person is considered not-guilty in the commission of a crime and cannot be subject to criminal punishment until he or she is found guilty by court.
