Illegal construction within Kyiv park area: new suspects

On November 15, 2023, NABU and SAPO expanded the circle of suspects to three persons in the case of the illegal allocation of part of the natural reserve fund (Nyvky Park) for construction. As a result, it caused about UAH 6.4 million in losses to the territorial community.

It concerns the former head of the unit of the Department of Land Resources of the KCSA and the former director of the company that, according to the decision of the Kyiv City Council, leased a land plot for development.

Their actions fall under Part 5 Art. 27, Part 2 Art. 28, Part 2 Art. 364 of the Criminal Code of Ukraine.

As established, the suspects succeeded in receiving inaccurate information about the unprotected status of the land plot. Aware of the inaccuracy of such information, the director of the Department of Land Resources of the KCSA used it to prepare and submit to the consideration of Kyiv City Council deputies a draft decision on transferring the parkland to a private company for the lease and construction of a residential-office complex. To ensure a favorable vote by the deputies of the Kyiv City Council on the relevant draft decision, the official, citing relevant information, indicated in the explanatory note that the plot did not belong to the nature reserve fund.

As a result, the company received the 0.6-hectare part of the park for construction, and the Kyiv community lost the right to use it as a nature reserve and suffered losses of UAH 6.4 million.

On Nov. 2, 2023, NABU and SAPO notified the current deputy head of the Kyiv City State Administration of suspicion of abusing his official position, which led to the illegal allocation of part of the natural reserve fund (Nyvky Park) for construction.

According to Article 62 of the Constitution of Ukraine, a person is considered not-guilty in the commission of a crime and cannot be subject to criminal punishment until he or she is found guilty by court.
